These Terms of Service govern access to and use of the Autobaza.hr platform and form a contract between you and the service provider. By using the platform you accept these terms in full.
- Definitions
- The platform is the Autobaza.hr online marketplace. The seller is an independent business (with an OIB) that offers auto parts. The buyer is the person placing an order. The service provider is Autobaza AB.
- Role of the platform
- The platform acts as an intermediary (agent) that lets sellers list their offers and processes payment and communication. The platform is not a party to the sales contract and does not sell parts in its own name.
- User account
- Ordering requires creating a user account with accurate details. The user is responsible for safeguarding their credentials and for all activity on their account.
- Contract formation and technical steps
- The sales contract is concluded directly between the buyer and the seller at the moment the buyer confirms the order and receives confirmation. The steps to conclude are: selecting a part, adding it to the cart, entering delivery details, reviewing the order, and confirming payment. Input errors can be corrected up until order confirmation.
- Pricing and tax
- All prices are shown in euros and, where applicable, include VAT. Delivery costs are shown before order confirmation.
- Payment
- Card payments are processed by the payment service provider Stripe. The platform facilitates collection and retains the agreed commission; the remaining amount belongs to the seller and is paid out to them via Stripe Connect. Card details are not stored by us.
- Seller obligations
- The seller warrants that it is authorized to sell the offered parts, that the description, condition, price and availability are accurate, and that it will fulfill the order within a reasonable time. As a trader, the seller is liable to the buyer under consumer-protection law.
- Buyer obligations
- The buyer agrees to provide accurate details, take delivery of the ordered part, pay the agreed price, and use the platform in accordance with the law.
- Prohibited conduct
- Posting false information, abuse of the ordering, review and communication systems, and any act that compromises the security or operation of the platform are prohibited.
- Reviews
- Only a registered buyer may leave a seller review, and only for an order placed through the platform — every review is tied to a specific order. We do not publish paid or fabricated reviews, nor do we edit their content.
- Intellectual property
- Platform content (logo, design, text, database) is protected and may not be used without authorization. By posting content, the seller warrants that it holds the necessary rights to it.
- Platform liability
- The platform provides the process for exercising the 14-day right of withdrawal and mediates in disputes. As it is not a party to the sale, the platform is not liable for the quality of the part or for damage caused by fitting or using the part contrary to the manufacturer’s instructions. Nothing in these terms excludes liability that cannot be excluded under mandatory law.
- Duration and termination
- The user may close their account at any time. The platform may restrict or terminate access in the event of a breach of these terms.
- Reporting notice (DAC7)
- As a platform operator we are required, under EU tax rules (DAC7), to collect and report to the competent tax authority data on the income sellers earn through the platform.
- Changes to the terms
- We reserve the right to amend the terms with prior notice to users. Continued use of the platform after the changes take effect is considered acceptance.
- Governing law and jurisdiction
- These terms are governed by the law of the Republic of Croatia. Disputes fall under the court with subject-matter jurisdiction at the service provider’s seat, without prejudice to mandatory consumer-protection and venue rules.
- Contract language and archiving
- The contract is concluded in Croatian. We store order data, which is available to the buyer through their user account.
As a consumer you have the right to withdraw from a distance contract within 14 days without giving any reason, in accordance with the Croatian Consumer Protection Act.
- Withdrawal period
- The 14-day period begins on the day you, or a third party you nominate (other than the carrier), take possession of the part. For multiple parts in one order delivered separately, the period runs from receipt of the last part.
- How to withdraw
- You withdraw by informing the seller (or the platform on their behalf) of an unequivocal statement of withdrawal before the period expires — via your account, by email, or using the attached withdrawal form.
- Withdrawal form
- You may also use a form with the following content: “To [seller / Autobaza.hr]: I [name] hereby give notice that I withdraw from the contract of sale of the following part [name], ordered on [date] / received on [date]. Address: [address]. Date: [date]. Signature (only if the form is submitted on paper).”
- Refunds
- On receiving notice of withdrawal we refund all payments received without delay, and within 14 days at the latest. We may withhold the refund until the part has been returned to us or you supply proof of return, whichever is earlier.
- Return costs
- For a damaged, defective or incorrectly shipped part, the seller bears the return cost.
- Exceptions to the right of withdrawal
- The right of withdrawal does not apply, among other cases, to parts made or customized to the buyer’s specification, and in other cases prescribed by law.
- Diminished value
- You are liable for any diminished value of the part resulting from handling beyond what is necessary to establish its nature, characteristics and functioning (for example, fitting it).
Independently of the right of withdrawal, the seller as a trader is legally liable for material defects of the part under the Croatian Obligations Act and Consumer Protection Act.
- Statutory guarantee
- The seller is liable for defects that existed at the time risk passed to the buyer. A defect is deemed to have existed at delivery if it appears within the period prescribed by law.
- Your rights
- For a material defect you may request remedy of the defect (repair), replacement, a price reduction, or rescission of the contract, under the conditions prescribed by law.
- Notification period
- Notify the seller of a visible defect without delay after you noticed it or should have noticed it, within the statutory periods.
- Relationship to the manufacturer guarantee
- Any commercial guarantee from the manufacturer is an additional right and does not affect your statutory rights against the seller.
Autobaza.hr lets you submit written complaints and mediates disputes between buyer and seller.
- Written complaint
- You can submit a written complaint via your account or to legal@autobaza.hr. We respond to the complaint, and forward it to the seller, in writing within 15 days of receipt.
- How to file a complaint
- In your complaint describe the problem, state the order number, and attach photos where applicable, for faster resolution.
- Platform mediation
- If the buyer and seller do not reach agreement, Autobaza.hr mediates and decides based on the documentation from both parties and, where justified, carries out a refund.
- Refunds via Stripe
- An approved refund is issued to the original payment method; for card payments the refund is processed through Stripe with a proportionate adjustment of the commission and the transfer to the seller.
- Alternative dispute resolution (ADR)
- You may attempt to resolve a consumer dispute before an alternative dispute resolution body.
- Online dispute resolution (ODR) platform
- The European Commission provides an online dispute resolution platform available at ec.europa.eu/consumers/odr. Our contact email for this purpose is legal@autobaza.hr.
